TERMS AND CONDITIONS OF SERVICE DOCUMENT AND PRIVACY POLICY

Who We Are? 

• “ABGA Systems and Software Trading Company LLC” for information technology with its registered office located in (United Arab Emirates - Deira - Dubai - Al Khabaisi - Al Ansari Building - Office No. 301), (hereinafter referred to as the company or the YEEO application).
• The YEEO application brings together or constitutes a link between customers and beneficiaries with general maintenance and construction services companies and all their types of service in one platform through the YEEO application and hereinafter referred to as (the “customer”, “the beneficiary”, “the service applicant”, “yours” or “your private property” or “service provider” or “person” or “general maintenance and construction services companies of all kinds of service”).
• ABGA Systems and Information Technology Trading Company LLC own and manage the YEEO application, and this application connects the customer with General Service providers such as maintenance and construction of all kinds of service without bearing any responsibility towards the subsequent contractual relationship between them.
• By downloading the application or accessing it in any way, the service provider and the service applicant, by signing this document agree to be bound by the following general terms and conditions and the following privacy policy and the two parties bear all obligations stipulated in this document without taking any liability by the YEEO application.
• There may be additional features in the Application, and such special features may have their own terms and conditions, and these additional terms and conditions will apply while using the Application in conjunction with the Terms and Conditions.

6. By clicking to agree to these terms, you have read, understood, and accepted the terms and conditions set forth in this document.

Service Applicant Terms and conditions and Privacy Policy:

• Taking responsibility and Privacy Policy

You agree that you have read, understood, and accepted the Terms and Conditions and assume all obligations set forth herein:

• That you have the authority to enter into this agreement and the legal capacity necessary to contract upon these Terms and Conditions.
• Any person who provides personal information in any way (including name, address collected on an aggregate and anonymous basis, gender and email address) to the Company via YEEO application or in conjunction therewith, whether via the Company's contact form, via e-mail and other means of communication. As part of the registration process, you will need to create an account, including a username and password shall be the responsibility of the service applicant and that you have ensured that the information you provide is accurate, non-misleading and relevant to you. You may not create an account or username and password using someone else's name and information or using words representing trademarks or owned by a third party including our company, or vulgar, obscene, or otherwise inappropriate, we only reserve the right and at our own discretion, with or without notice, to suspend or terminate any account in violation of these Terms and conditions.
• If you have doubts, for any reason whatsoever, that your username and password has been disclosed or obtained by a third party, you should contact us immediately and we shall not be liable for your loss or if your data is disclosed. Please note that we never contact users who are requested to confirm their username, password, or any other details.
• By becoming a user of our application, you acknowledge and agree to be bound by the Terms and Conditions. We shall have the right to suspend or stop providing the Services if you do not comply with our terms, conditions, and policies. Using our App and the various services we offer via our App shall not grant you any rights including intellectual property rights in our App and our Services or the content we provide except for your personal data or information uploaded to our App.
• You will not share your password (your secret code), nor to allow anyone else to access your account, or do anything else that might jeopardize the security of your account and we have no responsibility for your loss or disclosure of your private data.
• You will not transfer your account (including any page or application that you manage) to anyone without first obtaining our written permission.
• If you specify a username or similar identifier for your account or page, we reserve the right to remove or retrieve it if we believe it is appropriate (such as when the trademark owner complains about a username that is not closely related to the actual username)
• If you post comments that are unlawful, pornographic, harassing, hateful, obscene, defamatory, threatening, discriminatory, racist, cultural, ethnic, or incitement; advocate or express pornographic, obscene, vulgar, obscene, hateful, bigoted, racist or gratuitous violence, or encourage conduct that would be a criminal offence, give rise to civil liability or otherwise violate any law; or contains inappropriate topic, we reserve the right to remove it and permanently terminate your account.
• You hereby expressly acknowledge and agree that the Service Provider is the only person responsible for any personal or material damages you may incur because of the Services (“Damages”). The company (YEEO app) will not be liable for any damages you may suffer which are not a direct and foreseeable result of our special services. If you incur any damages, you should issue a claim for compensation directly to the Service Provider.
• We may disclose general information to the service applicant in accordance with our vision of our application YEEO for the benefit of the service we provide without Prejudice of the privacy of the beneficiary and without bearing the company – owner of the application YEEO any legal or moral liability.

1.11 By using the latest security technologies for data and systems, we do not bear any responsibility when the YEEO application or the “company” website is exposed to a security breach by entities, group, or individuals to steal and disclose public information or usage data of the application or website and use them in an illegal way.

Service Provider Terms and conditions and Privacy Policy:

1. Taking responsibility and privacy policy

The service provider shall abide by the general terms and conditions and the privacy policy contained in this document, and shall bear all legal obligations towards the service requester, including its choice of the customer requesting the service, and shall guarantee all damages and consequences sustained by the service requester as a result of the service it provides, including but not limited to Violations which may result before government and private agencies and third parties and all that may be related to the services it provides.

We may disclose general information about the service provider to the service requester in accordance with our own vision in the interest of the service we provide (via the YEEO application) without prejudice to the privacy of the provider, who relieves the company that owns the application from any legal and moral responsibility as a result.

Exemption AND Disclaimer  

1. The company’s role, through its YEEO application, is limited to linking the service applicant with the service provider and facilitating the process of obtaining the required service, and therefore it will not be responsible for any error, conflict or quality of services provided by the service provider. You acknowledge that the decision to hire a Service Provider is your sole responsibility. The Company seeks to verify the approved data of service providers registered in the State and its affiliated government departments. The Company makes no warranties or representations as to the date, character, age, experience, ability, suitability, honesty, or immigration status of any Service Provider nor with respect to the completeness, truthfulness or accuracy of any information, statement or reference provided by the service Provider. 

2. All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who created such content. We may not monitor or control the Content posted via the Service. Any use of or reliance on any content or materials posted via the Service or obtained by you through the Service is at your own risk. You understand that by using the Service, you may be exposed to content that may be offensive, harmful, inaccurate, or inappropriate. In no event will we be liable for any Content, including, without limitation, any errors or omissions in any Content, or any loss or damage of any kind that is not our responsibility and you incur because of using any Content available via the Service or broadcasted elsewhere.

3. You expressly understand and agree that the company or YEEO application will not be liable for any indirect, incidental, special, consequential, or exclusive damages, including without limitation, damages resulting from loss or profits, goodwill, usage, data loss or corruption or other intangible loss, even if the company has been advised of the possibility of such damages arising from the service provider. 

4. We disclaim and will not be liable for any damages arising from the services provided by the Service Provider and any damages incurred by you.

5. We do not warrant any obligation regarding the content within the Services, the specific functionality of the Services, and the suitability and reliability of the Services for your specific needs. The Company endeavors to ensure the suitability of Service Providers but cannot guarantee this. Suitability includes, but is not limited to, Service Provider personality, honesty, reliability, or professional ability. So, before engaging the service provider, you should satisfy yourself in all these matters.

6. The Company will not bear any legal responsibility and we will not be liable for any failure or delay in the performance of any of the obligations and promises of the Service Provider.

7. We are not responsible for any potential damages that may result from the use of devices with defective Internet access or outdated versions of browsers, or the application, or because of the failure of the device, browser or application.

Modifications to the Application, Content, Terms and Conditions

• The Company reserves the right at any time to modify or discontinue the YEEO Application or any part of it, temporarily or permanently, with or without notice to you. You agree that the Company shall not be liable to you or any third party for any modification, suspension or discontinuance of the Application, or any part of it. The most recent version of the Terms and Conditions posted on this page should supersede all previous versions.
• It is your responsibility to regularly check this page to determine if a new version of the Terms and Conditions has been uploaded. If you do not agree to any revisions of the Terms and Conditions, you must immediately stop using the Application.
• You agree that the Company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Application, or any part of it. Your continued use of the Application after such modifications or changes constitutes acceptance of your agreement to be bound by these Terms and Conditions, as amended.

Confidentiality of data and confidentiality in the use of data

1.1 The information that was provided to the “Company” during registration in the application or the website and the information that you take while using the application is confidential and is not shared except by law or by any competent regulatory authority.

1.2 The Company may disclose general information and application usage data to improve our Services and in our view in the interest of our Service to third parties (including but not limited to):

1.2.1 If the Company sells or purchases any business, assets, or applications, and in this case, the Company may disclose general information and application usage data to the prospective seller or buyer of such business or assets.

1.2.2 If the Company or essentially all its assets are acquired by a third party, in which case the general information and application usage data will be one of the transferred assets.

1.2.3 If the Company’s application or website is under an obligation to disclose or share the Company’s personal data to comply with any legal obligation, to enforce or apply these terms, conditions, and other agreements, or to protect the rights, property, or safety of the Company, or service providers, their customers, or others. This includes exchanging information with other public institutions and supervisory authorities for the purposes of fraud protection and credit risk reduction.

1.2.4 The company does not bear any responsibility when the YEEO application or the site of the “company” is exposed to a security breach by entities, group or individuals to steal and disclose public information or data and use of the application or site in an illegal way.

Ownership and Copyright

1.1 All copyrights in all materials contained in or available through the Application, Website, or social media platforms are owned by the Company or its owners, and you must comply with all copyright notices received.

1.2 You may not copy, modify, translate, post, reproduce, exploit, broadcast, transmit, distribute, perform, display, sell, or create any derivative works from, all or any part of the materials, and you may not use any of the materials in connection with any commercial endeavors, in whole or in part, and you may not alter the text, graphics, images, audiovisual or other materials.

1.3 Any unauthorized reproduction, publication, further distribution, or public display of the material, in whole or in part, is strictly prohibited.

1.4 The domain name, the Company name and logo and other Company names and logos that may be created, produced, or used from time to time (the “Marks”) are trademarks or registered trademarks of the Company and its affiliates. Without our express prior written permission, you agree not to display or use the marks in any way for any purpose and you will be subject to legal liability.

1.5 When using the service, the user undertakes not to harm the service, the users of the service, or the service providers, and also not to copy anything related to this service. If damage, copying, or the use of any of the symbols or anything indicating this service is proven in a way that harms the service and users, you agree to be legally responsible for this damage and bear full responsibility. 

Email Policy

1. We will not respond unless required by law to any email sent to us which contains threatening, abusive, malicious, pornographic, obscene, defamatory, illegal, or indecent material. We reserve the right to take such action as we deem appropriate at our sole discretion with respect to such material.

2. When required, we will endeavor to respond to all emails within two working days of receipt, but we are not obligated to strictly adhere to this deadline. All emails will be generally stored for seven (7) years after which they will be deleted. Any email sent to the incorrect destination is liable to be deleted immediately.

Payment and subscription policy of the service provider

1. The service fee is paid by the service applicant to the service provider based on what is agreed upon by the two parties in the application and it is subject to change in the course of work or negotiation between the two parties and you understand that the management of the company acts only as an intermediary in the agreement between you and the service provider and the company is not a party to this agreement.

2. The two parties choose the method of payment that they agree upon, in cash or by bank card, without any interference by the company.

3. Subscription packages are available on the company's official website, through which the service provider can subscribe to use the application services and renew the subscription.

General Provisions:

1. The company’s management has the right to suspend or cancel the subscription whenever it is proven to it and at its discretion that the subscriber has violated the terms of this contract while retaining all its other rights against it.

• The parties have agreed to refer any dispute that arises between the subscriber and the management of the company, to Dubai Courts, provided that the provisions of this agreement are the reference adopted in the consideration of this dispute.

3. The parties have reviewed the terms and conditions document and privacy policy for subscribing to the service (the service provided by the company through its application YEEO) and on the site and accepted it and committed to applying its provisions, satisfied with the conduct of the company’s management in interpreting these provisions and the results and subsidiary obligations incidental thereto.
